1. Parties
1 For the purpose of these Terms & Conditions of Business the following words shall have the following meanings:
(a) The ‘Customer’ shall mean the individual or organisation for whom Go Plumbers Ltd agrees to carry out works and/or supply materials.
(b) The ‘Work(s) or Service(s)’ shall mean the works described in the Go Plumbers Ltd estimate and/or as referred to in an invoice or any other document or verbal contract issued by the Go Plumbers Ltd, as may be varied by agreement in writing between the parties.
(c) The ‘Operative or Engineer’ shall mean the representative of Go Plumbers Ltd.
(d) The ‘Contract’ shall mean the agreed works between Go Plumbers Ltd & the Customer as defined by these Terms & Conditions of Business.
In these terms words importing the masculine gender also included the neuter and feminine gender and words importing the singular number include also the plural number where the context so requires.
2. General
2.1 All estimates either verbal or written given by Go Plumbers Ltd, all orders and instructions given by the Customer and all Works authorisations, are governed by these Terms & Conditions. They supersede any other terms appearing elsewhere and override and exclude any other terms stipulated, incorporated or referred to by the Customer, whether in the order or instructions or in any negotiations or in any course of dealing established between Go Plumbers Ltd and the Customer, except where these terms form part of a schedule to a signed Contract between the Customer and Go Plumbers Ltd, in which event these terms apply only to the extent not inconsistent with that Contract.
2.2 The Customer agrees that these terms, estimate or work authorisation shall constitute the entire understanding for the duration of work (as detailed in Section 4 below).
2.3 No modification to these terms shall be effective unless made by an express written agreement between the Operative and the Customer. The signing on behalf of Go Plumbers Ltd, of any documentation of the Customer, shall not imply any modification of these terms.
2.4 Nothing in this Contract is intended to confer on any individual, any right to enforce any term which that individual would not have but for this Contract (Rights of Third Parties Act 1999). Accordingly, any individual who is not a party to this Contract shall have no rights under that Act to enforce any of its terms, but this does not affect any right or remedy of such individual which exists or is available apart from that act.
3. Formal Prices
3.1 Formal Prices provided by Go Plumbers Ltd are subject to withdrawal by Go Plumbers Ltd at any time before the receipt of an unqualified acceptance from the Customer and shall be deemed to be withdrawn unless so accepted within 90 days from their date.
3.2 Go Plumbers Ltd reserves the right to increase the price of a Formal Price before carrying out the Works by an amount equivalent to any unforeseeable increase to Go Plumbers Ltd in the cost of relevant materials since the date upon which Go Plumbers Ltd estimate, written or oral, was given. Should any such increases result in the estimated formal price rising by more than 10%, the Customer may cancel the Contract provided they do so within 48 hours of the date the Works are due to commence. The Customer will be liable for cost of any materials ordered prior to cancellation.
3.3 Once Works have commenced and should it become clear that further unforeseen work is required in order to complete the Works, the Engineer will make all reasonable efforts to contact the Customer to advise of the extra costs of these required additional works. If the Customer is non-contactable, the Engineer will proceed with the required additional works only on the basis that in stopping the work, it would hold the job up and prevent a timely completion. The cost of any required, additional works will be added to the final invoice balance.
3.4 Where a written Formal Price has been supplied to the Customer, the total charge may be revised in the following circumstances:—
(i) If, after submission of the Formal Price, the Customer instructs Go Plumbers Ltd (whether orally or in writing) to carry out additional works not referred to in the Formal Price.
(ii) If, after submission of the Formal Price, there is an increase in the price of materials.
(iii) If, after submission of the Formal Price, it is discovered that further works need to be carried out which were unforeseen when the Formal Price was prepared.
(iv) If, after submission of the Formal Price, it is discovered that there was a manifest error when the Formal Price was prepared.
(v) Should a detailed Insurance Report be required in addition to the Formal Price and invoice, this will incur an additional charge.
3.5 Go Plumbers Ltd will not be under any obligation to provide a Formal Price to the Customer. Go Plumbers Ltd will only be bound to Formal Prices provided in writing to the Customer. Go Plumbers Ltd will not be bound to any estimates provided orally.
3.6 The Customer will reimburse Go Plumbers Ltd for any and all expenses incurred (including labour, materials and equipment hire) upon acceptance of a Formal Price which is subsequently cancelled by the Customer.
3.7 Go Plumbers Ltd reserves the right to refuse or decline any work at its own discretion. Where Go Plumbers Ltd agrees to undertake Works for the Customer, this will be done so by authorised representatives of Go Plumbers Ltd only.
4. Illustrations and Imagery
4.1 Any illustrations or imagery displayed on the Go Plumbers Ltd website, in marketing materials (both offline and online), catalogues, price lists or other, are intended merely to present a general idea of the products, Works and Services provided by Go Plumbers Ltd. No part of the above shall form part of any Contract.
5. Rates, Charges & Payment Terms
5.1 Go Plumbers Ltd charges a minimum 1 hour fee for all appointments, regardless of Works carried out and includes Works quoted on an hourly rate or estimated Works. If for any reason Go Plumbers Ltd are unable to carry out Works during attendance, the minimum 1 hour fee would still be payable for our attendance, plus the cost of any additional labour time over the first hour and parts/materials and parking fees, if applicable.
5.2 Where Works are not carried out under the terms of an estimate, the Customer agrees to pay Go Plumbers Ltd the labour fee for the supply of Services at the rate shown on the Go Plumbers Ltd website. In addition to the fee for labour, Go Plumbers Ltd will charge the Customer for parking, materials, congestion charges and any other expenses or purchases required to carry out the Works.
5.3 All charges are subject to VAT at the prevailing rate.
5.4 All invoices are due for payment on the invoice due date, as stated on the invoice.
5.5 Where any Services or Works provided by Go Plumbers Ltd are subject to snagging, the Customer agrees to make payment of 95% of the total invoice amount immediately following completion of Works. The Customer must then provide Go Plumbers Ltd access without delay to allow the snagging to be finalised and completed. Payment for the remaining 5% balance will be due following completion of the snagging by Go Plumbers Ltd, or within 14 days of the invoice date should access not be made available – whichever is sooner. In the event of a more serious issues, the Customer may be able to withhold more than 5% of the total invoice on agreement with Go Plumbers Ltd.
5.6 Where the Customer is represented by a third party, person(s) or agent(s) (such as a managing agent, landlord, tenant or other occupier, friend, family, contractor or other representative), in the event of non-payment by the Customer, the third party will be responsible for full payment unless Go Plumbers Ltd has agreed otherwise, in writing, prior to any works commencing.
5.7 For any late payments of an invoice, whether in part or in full, the Customer will be subject to the daily interest rate of 3% over the base rate, until the payment is received in full by Go Plumbers Ltd. Further, in the event of delayed or non-payment of charges, Go Plumbers Ltd reserves the right to charge reasonable administration fees incurred for pursuing payment. If payment is overdue by more than 28 days then this debt will be passed onto a debt collection agency and will incur their additional fees.
5.8 Payment terms for estimate Works;
(i) Some Works estimated by Go Plumbers Ltd will be subject to a deposit payment before Works are undertaken for the Customer. The deposit amount will not exceed £499.00. The balance of the quoted/estimated Works inc VAT will be due on completion of the Works undertaken. This is to cover material costs for larger items ordered by Go Plumbers Ltd prior to Works commencing.
5.9 Payment terms for hourly rate Works;
(i) The total charge payable by the Customer shall consist of the cost of materials supplied by Go Plumbers Ltd, parking fees (if applicable) and the minimum labour charge for the first hour and half hourly increments after that. If the Works cannot be completed on the same day and a return visit is made, the minimum hourly rate charge shall apply for the first hour followed by hourly increments.
5.10 Go Plumbers Ltd reserves the right to charge a fee for the collection of materials from suppliers except with respect to Works for which there is an estimate. If the collection occurs whilst the Engineer is on site, the time taken will be treated as an addition to the Works and charged at the relevant rate. Go Plumbers Ltd will make all reasonable efforts to ensure that collection times will be kept to a minimum and should a collection time be likely to exceed 1 hour, all reasonable efforts will be made to notify the Customer.
5.11 The costs for servicing a boiler or other appliance do not include repairs that may be required.
5.12 The costs for carrying out a gas safety inspection do not include remedial works that may be required.
6. Inspection, Delivery and Completion of Works
6.1 Go Plumbers Ltd will advise the Customer of the date and time for works to be carried out. Go Plumbers Ltd will endeavour to ensure they maintain this schedule and that their Operatives attend at the agreed time. However, Go Plumbers Ltd accepts no liability in respect of late/non-attendance at any site, or for the late/non-delivery of any equipment or materials. All times provided by Go Plumbers Ltd are estimates only.
6.2 Go Plumbers Ltd shall not be liable for any delay or for the consequences of any delay in performing any of its obligations, if such delay is due to any cause whatsoever beyond its reasonable control, and Go Plumbers Ltd shall be entitled to a reasonable extension of the time for performing such obligations should such a situation arise.
6.3 Where other trades are involved in the works and these trades are not under Go Plumbers Ltd control, any delays that may be caused to Go Plumbers Ltd’s progress by these trades, may be subject to an extra charge and/or delay in completion.
6.4 Go Plumbers Ltd cannot provide an emergency service. Go Plumbers Ltd cannot guarantee the time of response, including in relation to warranty issues. Go Plumbers Ltd will use reasonable endeavours to send an Engineer as soon as possible.
6.5 The Customer shall inspect the works as far as it is reasonably possible to do so, immediately upon their completion. If the Customer considers that the works or any part thereof are not in accordance with the Contract, they shall, as soon as reasonably practical, give detailed notice in writing thereof.
7. Guarantee
7.1 If, after Go Plumbers Ltd shall have carried out Works, the Customer is not wholly satisfied with the Works, then the Customer shall give written notice as soon as reasonably practical to Go Plumbers Ltd and shall afford Go Plumbers Ltd, and its insurers, the opportunity of both inspecting such Works and carrying out any necessary remedial Works, if appropriate.
7.2 The Guarantee shall be for labour only, in respect of faulty workmanship, for 12 months from the date of completion with the manufacturer’s warranty in force. The Guarantee will become null & void if the Works completed and/or appliance supplied by Go Plumbers Ltd is:
(i) Subject to misuse or negligence.
(ii) Repaired, modified or tampered with by anyone other than a Go Plumbers Ltd Operative.
(iii) Go Plumbers Ltd will accept no liability for, or guarantee suitability, materials supplied by the Customer & will accept no liability for any consequential damage or fault.
7.3 Go Plumbers Ltd shall not guarantee any work in respect of powerflushes, blockages in waste and drainage systems, airlocks, replacement tap washers or any other small fix which could be considered to be of a temporary nature.
7.4 Go Plumbers Ltd will not guarantee any work undertaken on instruction from the Customer & against the written or verbal advice of the Operative.
7.5 Works are guaranteed only in respect of Works directly undertaken by Go Plumbers Ltd. Any un-related faults arising from recommended Works which have not been undertaken by Go Plumbers Ltd will not be guaranteed.
7.6 Go Plumbers Ltd shall not be held liable or responsible for any damage or defect resulting from Works not fully guaranteed by Go Plumbers Ltd or where recommended Works have not been carried out.
7.7 Where Go Plumbers Ltd agrees to carry out Works on installations of an inferior quality or over 10 years old at the time of inspection, no warranty is given in respect of such Works and Go Plumbers Ltd accepts no liability in respect of the effectiveness of such Works or otherwise.
7.8 When Go Plumbers Ltd carries out Works to change a system from low pressure to high pressure, the Customer accepts that there is a possibility that the Customer’s existing pipe work, washers, joints and or fittings, may suffer leaks as a result of the change in pressure. There may also be an effect on the ballvalves, the cartridges of some showers and taps which the Customer may need to upgrade to cope with the pressure changes. Go Plumbers Ltd will repair any such leaks and/or install new ballvalves or cartridges at an extra charge to be agreed, if and when necessary.
7.9 When a powerflush is carried out, the Customer accepts and agrees that there is a possibility that the Customer’s existing pipework and or fittings may suffer leaks as a result of the cleansing process. Go Plumbers Ltd will repair any such leaks at an extra charge to the Customer, if and when they occur.
7.10 Nothing in this term will affect the Customers rights under the Consumer Rights Act 2015.
8. Title to Goods
8.1 Title to any goods, supplied by Go Plumbers Ltd to the Customer shall not pass to the Customer but shall be retained by Go Plumbers Ltd until payment in full for such goods has been made by the Customer to Go Plumbers Ltd. Until such time as title in the such goods has passed to the Customer:
(i) Go Plumbers Ltd shall have absolute authority to reclaim, sell or otherwise deal with or dispose of all any or part of such goods in which title remains vested in Go Plumbers Ltd;
and
(ii) Go Plumbers Ltd shall be entitled to seek a court injunction to prevent the Customer from selling, transferring or otherwise disposing of such goods. Notwithstanding the foregoing, risk in such goods shall pass on delivery of the same to the Customer, and until such time as title in such goods has passed to the Customer, the Customer shall insure such goods to their replacement value and the Customer shall forthwith, upon request, provide Go Plumbers Ltd with a certificate or other evidence of such Insurance.
9. Indemnity
9.1 The Customer shall indemnify Go Plumbers Ltd against any and all actions, claims, demands, losses, suits, costs, expenses and charges which Go Plumbers Ltd may suffer or incur in connection with a claim by a third party, resulting from a breach of the Customers obligations, undertakings and representations and warranties in connection with this Contract.
10. Limitation of Liability
10.1 Go Plumbers Ltd warrant that Go Plumbers Ltd will provide the Services with reasonable care and skill.
10.2 Subject to the provisions of Condition 10.6, Go Plumbers Ltd entire liability in respect of any breach of Go Plumbers Ltd contractual obligations arising under or in connection with Go Plumbers Ltd Services, shall be limited to the aggregate of all Fees paid to Go Plumbers Ltd by the Customer for the provision of the Services up to the date of the event giving rise to such liability.
10.3 Go Plumbers Ltd shall not be liable for the following loss or damage, howsoever caused:-
10.4.1 Loss of profits, business or revenue, whether suffered by the Customer or any other person;
10.4.2 Unforeseeable special, indirect, incidental or consequential loss, whether suffered by the Customer or any other person;
10.4.3 Any losses arising by reason of any events or other matters beyond Go Plumbers Ltd reasonable control preventing the performance by Go Plumbers Ltd of any obligation under these Terms, provided that Go Plumbers Ltd shall use all reasonable endeavours to eliminate or overcome any of such causes and to resume performance of their obligations with all possible speed;
10.4.4 Any losses resulting from the Customer’s failure to comply with any recommendations made by Go Plumbers Ltd or from any defects in the Customer’s premises, fixtures, fittings and finishes, equipment, installations and goods; and
10.4.5 Any losses resulting from any act or default on the part of the personnel supplying the Services that arises from matters outside the scope of Go Plumbers Ltd duties under these Terms.
10.4 Where it is agreed between Go Plumbers Ltd and the Customer that parts and materials are to be stored at a place nominated by the Customer, this shall be at the Customer’s own risk. The Customer hereby agrees to reimburse Go Plumbers Ltd, in full, for any losses incurred as result of this situation.
10.5 Any materials supplied, including boilers, are subject to their own manufacturer’s warranty and guarantee. The Customer agrees that Go Plumbers Ltd are not liable for the installation of any faulty items where it was not reasonably apparent that the item was faulty before installation. If an item is faulty at installation or becomes faulty after installation, the Customer agrees to contact the manufacturer directly and claim under the manufacturer’s warranty and guarantee.
10.6 Nothing in these Terms shall purport to exclude or restrict Go Plumbers Ltd liability for death or personal injury resulting directly from our negligence in carrying out the Services.
10.7 Where the Customer supplies goods or materials, Go Plumbers Ltd accepts no responsibility for any defects or damage and offers no guarantee for these goods or materials.
10.8 Unless proved to have been negligent, Go Plumbers Ltd will not hold responsibility or liability for damage caused whilst investigating and repairing any plumbing, gas or drainage work, including blockages. This includes but is not limited to; the removal of bathroom panels or furniture, tiles and tiling, floor coverings (carpet, rugs, laminate, wood, tiles etc), internal and external walls where pipework is/has to be routed and other damages as a result.
10.9 If damage to plaster and brickwork is caused it will be the Customer’s responsibility to make good. Go Plumbers Ltd cannot accept responsibility for any damage to wallpaper, paintwork, tiles, carpet, furniture etc unless Go Plumbers Ltd have been proved to be negligent.
10.10 Any redecorating required as a result of works undertaken by Go Plumbers Ltd is the responsibility of the Customer unless explicitly stated in writing. Where making good is required Go Plumbers Ltd agrees to do so in order to maintain the integrity of the building fabric.
10.11 Go Plumbers Ltd shall not be liable for any breakdown or poor performance of or damage caused to the Customer’s existing plumbing, heating or drainage as a result of pre-existing faulty pipe work or some other pre-existing defect or malfunction. Go Plumbers Ltd cannot accept liability for any deterioration in the performance of the Customer’s plumbing and heating systems caused by fluctuations in the water or gas pressures provided by the Customer’s service provider.
10.12 Go Plumbers Ltd shall not be liable for any leakage or fault arising from operating stop cocks or valves required to carry out our Works. It is the responsibility of the Customer to make available the locations of stop cocks and pressure valves so that the Works can proceed.
11. Customers Liability
11.1 The Customer shall be liable for any loss, damage or injury whether direct or indirect or consequential, resulting from failure or delay in the performance of the Customer’s obligations under these terms.
11.2 The Customer shall be liable for providing all necessary power and a clean water supply for the Engineer’s use in the execution of the contracted Works.
11.3 Both parties shall be liable for the safety of both plant and machinery belonging to or hired by Go Plumbers Ltd and to indemnify Go Plumbers Ltd against its loss, theft or damage whilst at the premises where the Works are being carried out, for the duration of the Works.
11.4 The Customer will at all times ensure the working environment is safe for Go Plumbers Ltd, its Engineers and Operatives for the purpose of carrying out the Works.
11.5 Where parking and congestion restrictions apply, the Customer is responsible for providing parking permits/vouchers or fees within 100m of the property unless otherwise expressly agreed with Go Plumbers Ltd. Where local meters/“Pay and Display” do not offer the required time period and/or where such arrangements are not made the Customer will be liable to pay any parking fine or penalty, and any parking fine, penalty or other charge may be added to the invoice for any Works carried out.
11.6 The Customer shall be solely liable for any existing hazardous situation in respect of GSIU Regulations or a Gas Warning Notice issued.
11.7 All gas installations will be tested for leaks prior to the commencement of any related Works. Go Plumbers Ltd is unable to work with a gas installation if it does not comply with Gas Safety (Installation and Use) Regulations 1998. This includes working gas pressures. Gas pipe work must conform to BS6891 and be sufficiently sized to suit the installation. Unless otherwise stated, upgrading of gas supplies is classed as additional Works and will be charged accordingly.
11.8 Where the involvement of an emergency service is necessary (for example, National Grid), it may not be possible for the Engineer to remain on site for their arrival. It is the responsibility of the Customer or their representative to allow access required by the service(s) in question.
11.9 It is the Customer’s duty to ensure suitable permission, permits, authorisations, licenses and all other consents including planning permission (if necessary) from the owner/landlord/agent/organisation/local authority, is obtained prior to installation work carried out by Go Plumbers Ltd. Go Plumbers Ltd will not be held responsible for any damage to the property (such as fixings, holes etc.) if this has not been obtained, and in the event of equipment supplied or installed, requiring removing or re-positioning, extra charges will be incurred.
11.10 The Customer shall provide clear access to enable Go Plumbers Ltd to undertake the Works, and will make all the necessary arrangements with the proper persons or authorities for any traffic controls and signals required in the connection with carrying out the Works.
11.11 The Customer shall obtain permission for Go Plumbers Ltd to proceed over property belonging to neighbours or third parties if this is necessary. The Customer shall indemnify Go Plumbers Ltd in all aspects of claim from neighbouring/third party properties arising out of the presence of Go Plumbers Ltd or its Engineer’s/Operatives.
11.12 The Customer shall be liable for ensuring that children and pets are kept a safe distance away from the areas where the Works are being carried out, for their own safety.
11.13 It is the responsibility of the Customer to protect items of furniture, furnishings, fixtures and fittings. We will make reasonable efforts not to cause damage. It is suggested that the Customer remove items that are considered to be of great value or irreplaceable to the Customer. If any such items remain within the working area, it is the responsibility of the Customer to protect such items.
12. Defects
Subject to Clause 9 above and the exclusions listed below, Go Plumbers Ltd undertakes to repair or make good any defect in completed Works which appears within 12 months of completion of the same, to the extent that such defect arises from a breach of Go Plumbers Ltd obligations under this contract and provided that details of the defect are notified by the Customer to Go Plumbers Ltd in writing, within such period and that Go Plumbers Ltd and its insurers are given the opportunity of inspecting the work and the alleged defect.
This undertaking shall only apply to work carried out and completed and invoiced by Go Plumbers Ltd and which is paid for by the Customer by the due date for payment ascertained in accordance with Clause 5.5 above. If Go Plumbers Ltd returns to the site at the Customer’s request to review a claim under this undertaking and it transpires that the defect had not arisen as a result of a breach of this contract on the part of Go Plumbers Ltd, Go Plumbers Ltd reserves the right to charge the Customer for the visit at its standard rate as per Clause 5.10 above.
Go Plumbers Ltd reserves the right not to carry out any work where the Customer cannot evidence that the Works were originally carried out and completed by Go Plumbers Ltd.
Go Plumbers Ltd will only be liable for rectifying their own Works.
Go Plumbers Ltd shall be entitled to recover the costs or damages from any person or contractor whose negligence or faulty workmanship makes us liable to pay for those damages or rectification of Works.
Exclusions are:
12a Parts and materials will be provided only with the benefit of the manufacturer’s / supplier’s guarantee.
12b Any systems, structure, parts/materials not originally installed by Go Plumbers Ltd.
12c Any recall arising from circumstances or factors known to the Customer but not notified or disclosed to Go Plumbers Ltd prior to the work having been undertaken.
12d Defects resulting from misuse, wilful act, or faulty workmanship by the Customer or anyone working for or under the direction of the Customer other than Go Plumbers Ltd.
12e Structural defects encompassing but not limited to subsidence and its resultant effect.
12f Any previous works undertaken by Go Plumbers Ltd that has been affected by any other outside force out of Go Plumbers Ltd’s control.
12g Any work where Go Plumbers Ltd has stated either verbally or in writing, that the work to be undertaken is not advisable and another option is recommended. For example, the instruction from the Customer to attempt to repair an object, system, part that Go Plumbers Ltd has advised to replace for a more cost effective and reliable outcome.
13. Force Majeure
13.1 Go Plumbers Ltd shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, industrial disputes, lock outs, accidents, war, fire, any problem with the safety, security or fabric of the site, breakdown of plant or machinery, delay or failure on the part of a third-party supplier or subcontractor, or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension for performance of its obligations.
13.2 If any force majeure event shall continue for more than one calendar month Go Plumbers Ltd shall have the right to terminate this Contract by written notice.
14. Cancellation
14.1 If the Customer cancels the Contract without Go Plumbers Ltd consent other than pursuant to Clause 3.3 above & 14.4 below, the Customer shall indemnify Go Plumbers Ltd against all loss, damage, claims or actions arising out of such cancellation unless otherwise agreed in writing, and for the avoidance of doubt, any such cancellation is without prejudice to Go Plumbers Ltd’s right to payment in accordance with Clause 5 above.
14.2 If the Customer wishes to cancel an appointment for a visit by Go Plumbers Ltd within 24 hours of the scheduled Works commencement, the Customer will incur a cancellation fee of 50% of the quoted fixed labour cost or 50% of the quoted first hour’s labour minimum charge dependent on the scheduled Works.
14.3 In instances when the appointment for a visit from Go Plumbers Ltd has been made by a third party (managing agent, landlord etc) whom is not arranging the access at the property, but has instructed the works, any cancellations or inability to access the property by Go Plumbers Ltd will be subject to our cancellation policy as stated in the Clause 14.1 & 14.2 above.
14.4 The Customer has the right to cancel any scheduled Works within fourteen calendar days starting on the day the Notice of Right to Cancel is issued. Should you send your cancellation notice in writing via post, it is recommended you retain proof of postage by a certificate of posting, or recorded delivery slip. Go Plumbers Ltd advise that all Notice of Rights to Cancel are sent via email to info@goplumbers.co.uk. Notice of cancellation is deemed to be served as soon as it is received.
15. Removal of Waste Materials
15.1 Unless agreed in writing between the parties, the Customer will be responsible for the removal from site of all waste materials resulting from the works.
16. Frozen Pipes
16.1 Go Plumbers Ltd will not be liable for any fracture found in frozen pipes attended by Go Plumbers Ltd will not guarantee to clear blockages occurring in a frozen pipe or drains.
17. Dangerous Gases, Liquids and Materials
17.1 Prior to the commencement of the Works, the Customer shall inform us of all dangerous gases, liquids and any other materials of any nature whatsoever (including but not limited to asbestos) which are present on the premises where the Works is to be carried out by Go Plumbers Ltd and which could constitute a danger to the Engineer in carrying out the Works or otherwise.
17.2 Go Plumbers Ltd will not carry out any Works, or continue Works in the instance any dangerous substance is found to be present or suspected to be present. Works will only re-commence on production of communication or a Certificate from the relevant authority confirming the dangerous substance has been removed and the area is safe.
17.3 The Customer shall also ensure that Go Plumbers Ltd are notified in good time and properly advised in writing of all precautions which need to be taken on account of the presence of such dangerous materials. The Customer shall provide suitable cleaning facilities and, if circumstance require it, a qualified and competent safety inspector to advise upon how the Works can be safely carried out. The Customer shall also notify us in writing of any special requirements laid down by the building control inspector or similar authority. The Customer shall be responsible for all loss or damage whether direct, indirect or consequently due to the Customer’s failure to fulfil any of the above obligations. If the Customer shall fail to comply with the above we shall be under no obligation to carry out the Works.
18. Waiver, Variation etc.
18.1 No waiver by Go Plumbers Ltd of any breach by the Customer shall operate as a waiver of any preceding or subsequent breach by the Customer. No variation shall be effective against Go Plumbers Ltd unless sanctioned in writing by Go Plumbers Ltd. No forbearance or delay on Go Plumbers Ltd part shall prejudice Go Plumbers Ltd rights and remedies under this Contract.
19. Complaints
19.1 In the event that the Customer wishes to make a complaint about any aspect of Go Plumbers Ltd’s work, Engineers or Operatives please fill out the form on the link http://goplumbers.co.uk/complaints.php The complaint will be investigated and the Customer will be responded to within 10 working days. Go Plumbers Ltd takes all complaints very seriously and welcomes the opportunity to resolve issues swiftly.
19.2 We always endeavour to provide the best service and products for our customers. However, on rare occasions, we recognise that there may be times where our customers may not be completely satisfied. To ensure we are able to put things rights as soon as we can, please read our Complaints Procedure here and we will respond promptly to ensure complete satisfaction. As soon as possible after the completion of the works, please inspect the work to ensure everything has been carried out to our usual high standards. In the unlikely event there is anything you are not completely satisfied with, please contact us as soon as you can in order that we can rectify any problems as soon as possible. Where we cannot resolve any complaints using our own complaints procedure, as a Which? Trusted trader we use Dispute Resolution Ombudsman for dispute resolution. 20. Notices
20.1 Any notice to be given by either party to the other may be sent by either email or post to the address of the other party or such other address as such part may from time to time have communicated to the other in writing. If the notice is sent by email, it will be assumed to be received on that working day. If post mailing was used, it shall be deemed to be served three days following the date of posting.
20.2 All correspondence to Go Plumbers Ltd can be sent to the registered address, this being; 32 Station Road, West Byfleet, Surrey KT14 6DR.
20.3 All calls, voicemails and text messages to and from Go Plumbers Ltd may be recorded, logged and stored.
21. Other
21.1 These Terms & Conditions may not be released, discharges, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorised representative of Go Plumbers Ltd & by the Customer. Further, these Terms & Conditions shall prevail over any Terms & Conditions used by the Customer or contained or set out or referred to in any documentation sent by the Customer to Go Plumbers Ltd. By entering into a contact with Go Plumbers Ltd, the Customer agrees irrevocably to waive the application of any such terms & conditions.
21.2 By using Go Plumbers Ltd, the Customer automatically agrees to accept and adhere to the above Terms & Conditions.
21.3 To the extent that any provision of these Terms & Conditions is void, voidable or unenforceable, that fact shall not affect the operation of any other clause, sub-clause or part thereof.
21.4 These Terms &Conditions and all contracts awarded between Go Plumbers Ltd and the Customer shall be governed and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
